Class Action Suit

The lawsuit emerged after a photo went viral in 2013 that aligned a Subway “footlong” sandwiches next to a ruler, showing that the sandwich only measured about 11 inches in length.

Subway said that it had “previously allowed for a small tolerance in the size of a footlong sandwich” but will now require that all subs reach 12 inches in length.

The chain will have inspections to ensure proper protocol is being carried out, and will levy fines against those who don’t meet the new standards.

As part of the proposed ettlement, Subway has agreed to pay $1,000 to the plaintiffs and a much larger amount in legal fees: $525,000.

The agreement is subject to approval at a hearing scheduled for January 2016.
